§ 30-57. Powers.

  • The enforcement board and special masters shall have the power to:

    (1)

    Adopt rules for the conduct of its hearings.

    (2)

    Subpoena alleged violators and witnesses to hearings. Subpoenas may be served by the sheriff of the county or the police department of the city.

    (3)

    Subpoena evidence.

    (4)

    Take testimony under oath.

    (5)

    Issue orders having the force of law commanding whatever steps are necessary to bring a violation into compliance.

    (6)

    Issue orders assessing costs incurred in the prosecution of the case before the enforcement board and special masters, if the city prevails.

    (7)

    Issue orders having the force of law regarding reasonable repairs which are required to be made in order to bring the subject property into compliance, and charge the violator with the reasonable cost of the repairs, along with the fine, to be paid pursuant to this article, in accordance with section 30-83.

    (8)

    Assess, levy and/or impose a civil penalty not to exceed $250.00 per day for a first violation, $500.00 per day for a repeat violation, and $5,000.00 per violation if the enforcement board or the special master finds the violation to be irreparable or irreversible in nature.
